Get to know industrial designs in IPR

One of the areas of protection of intellectual property rights is industrial design. Industrial design is a creation of the shape, configuration, or composition of lines or colors, or lines and colors, or a combination thereof which is three-dimensional or two-dimensional which gives an aesthetic impression and can be realized in three-dimensional or two-dimensional patterns and can be used to produce a product, goods, industrial commodity, or handicraft. The definition in article 1 number 1 of Law number 31 of 2000 (UU Desain Industri) is certainly not easily understood by the general public. So that it needs to be described in more detail.

Broadly speaking, this industrial design is a product that appears physically which shows that the product has a certain shape and pattern. This form when seen directly, people can find out the name of the item and its function for what. So that a new product can be said to be a design, it must have a certain function. Because that function is what distinguishes the form as a design or merely a work of art.

Scientifically, design itself is referred to as applied art which can mean both a noun and a verb (process). Design is a part of creativity, where the basis of creation is from an idea. That is the background of the importance of protecting the intellectual property of industrial design, because the basis for protection is the original idea in creating art creations in the form of designs.

Why is the protection of industrial designs important? This is inseparable from the consequences because Indonesia has ratified the Agreement Establishing the World Trade Organization which includes the Agreement on Trade Related Aspects of Intellectual Property Rights (TRIPs Agreement) through Law No. 7 of 1994 concerning Ratification of the Agreement Establishing The World. Trade Organization (Agreement to Establish the World Trade Organization). In addition, another purpose of protecting industrial designs is to promote and encourage industries in Indonesia which are so rich to make designs that have good quality.

There are quite a lot of products that fall into the industrial design category, in the Lucano classification there are 33 classifications of goods that can be registered for industrial design protection. Knowing this classification is very important, because each product has its own category. This is to make it easier for people who will check, so they can recognize that the product is in the design category in what class. Knowledge of this classification is important to simplify the registration process. Even though in registration there are administrative and substantive inspection stages on the appropriateness of the industrial design being registered, it does not mean that registration of industrial designs is difficult. The applicant has many opportunities to complete these requirements if the examination team finds deficiencies and the registration can be withdrawn.
