Belajar Mengatasi Pembajakan Dari Negara Lain

Indonesian Television Plagiarist, Running Out of Ideas Again?

The Korean Drama series ‘Squid Game’ is a series that takes quite a long time in the manufacturing process. The director of this series even started thinking about the concept since 2008. No wonder so many people follow the trend of the series. However, what this Indonesian TV station did was plagiarism. We all know that plagiarism is plagiarizing or taking essays, opinions, and so on from other people and making them look like their own compositions and opinions. Plagiarism can be considered a crime because it steals the rights of others. As regulated in Law no. 28 of 2014 concerning Copyright. This is why filmmaker should consider registering their work of art to WIPO indonesia.

To be honest, I think it’s been a long time since Indonesian television has paid attention to the quality of the shows that are presented. The concept of the story that is made up to the execution also always seems rushed and careless. The plots that are made are also often out of the original concept of the story, including in the soap opera ‘Dari Jendela SMP’. The question that often pops into my head is ‘Did the creative team run out of ideas? Do you have to always follow the existing trends to be used as a reference story?’. I have always felt that the characteristic of Indonesian soap operas is to follow whatever is currently booming and I think that is a strange thing.

Long before this plagiarism problem, I had seen a snapgram of one of the scriptwriters for Indonesian TV soap operas. In the snapgram he said that actually not a few of them had a good story concept but when it was close to the shooting day, the director was asked to change the script again on the grounds that it was less attractive and did not suit their target market. That is, here is that they assume that their target market is people with low taste. So, it is not suitable if given a good and weighty story. He also mentioned that he was often asked to revise his story a few hours before filming.

Imagining this, it is not surprising that the stories in Indonesian soap operas are less mature and seem rushed. Only rely on dramatized stories and trivial stories that cannot be separated from the problem of love.

Whereas initially Indonesian soap operas were not as bad as now. Although the story is still about romance dramas, at least it is still packaged quite well because it takes one week to air on television. There is still time to make a story that is more prepared and not as rushed as it is now. The term is like chasing the show and if you say schoolchildren, SKM (System Speeding Overnight). I also cannot deny that the biggest goal of producing soap operas is none other than to get the maximum turnover.

There have been 1,184 cases of Intellectual Property Rights Violation Acts in Indonesia since 2015

The government is recorded to have handled 1,184 cases related to violations of intellectual property rights or intellectual property rights in the last five years. The number of violations has made Indonesia still hold the priority watch list or PWL status in terms of intellectual property, thus hampering investment. This is why a discussion with law firm jakarta is needed.

The Head of the Criminal Investigation Unit of the National Police, Agus Andrianto, explained that basically, the police are tasked with enforcing the law related to intellectual property rights. The National Police take action against products that violate Haki, in collaboration with a number of ministries. In 2015–2021, 1,184 cases of intellectual property rights violations were handled, with 958 of them handled by the National Police. A total of 658 cases related to trademarks, 243 copyright cases, 27 industrial design cases, 8 trade secret cases, 2 integrated circuit layout cases, and 2 plant variety protection cases.

In addition to the Police, the handling of intellectual property rights violations is also carried out by the Directorate General of Intellectual Property of the Ministry of Law and Human Rights (DJKI Kemenkumham). Of the 226 cases handled by DJKI, 115 cases are in process, 4 cases are declared P-21, and 107 cases are issued SP3.

According to Agus, one of the challenges in handling Haki cases is the law which is a complaint offense. Police investigators and other ministries require a complaint from the copyright holder before taking action. On the other hand, the investigation must be stopped when the complaint is withdrawn because the law is a complaint offense.

Therefore, the National Police urges all parties experiencing problems related to Intellectual Property Rights to report their intellectual property so that the perpetrators receive legal action. “The investigation of 656 cases was terminated, 68 percent due to the revocation of reports from the rights holders or their proxies. That is a consequence of the nature of the complaint,” said Agus. Director General of Intellectual Property (Directorate General of Intellectual Property) Kemenkumham Freddy Harris assessed that law enforcement related to IP is important to improve the investment climate in Indonesia. This is because the enforcement of IP law is one of the indicators for most investors who want to invest in Indonesia.

Get to know industrial designs in IPR

One of the areas of protection of intellectual property rights is industrial design. Industrial design is a creation of the shape, configuration, or composition of lines or colors, or lines and colors, or a combination thereof which is three-dimensional or two-dimensional which gives an aesthetic impression and can be realized in three-dimensional or two-dimensional patterns and can be used to produce a product, goods, industrial commodity, or handicraft. The definition in article 1 number 1 of Law number 31 of 2000 (UU Desain Industri) is certainly not easily understood by the general public. So that it needs to be described in more detail.

Broadly speaking, this industrial design is a product that appears physically which shows that the product has a certain shape and pattern. This form when seen directly, people can find out the name of the item and its function for what. So that a new product can be said to be a design, it must have a certain function. Because that function is what distinguishes the form as a design or merely a work of art.

Scientifically, design itself is referred to as applied art which can mean both a noun and a verb (process). Design is a part of creativity, where the basis of creation is from an idea. That is the background of the importance of protecting the intellectual property of industrial design, because the basis for protection is the original idea in creating art creations in the form of designs.

Why is the protection of industrial designs important? This is inseparable from the consequences because Indonesia has ratified the Agreement Establishing the World Trade Organization which includes the Agreement on Trade Related Aspects of Intellectual Property Rights (TRIPs Agreement) through Law No. 7 of 1994 concerning Ratification of the Agreement Establishing The World. Trade Organization (Agreement to Establish the World Trade Organization). In addition, another purpose of protecting industrial designs is to promote and encourage industries in Indonesia which are so rich to make designs that have good quality.

There are quite a lot of products that fall into the industrial design category, in the Lucano classification there are 33 classifications of goods that can be registered for industrial design protection. Knowing this classification is very important, because each product has its own category. This is to make it easier for people who will check, so they can recognize that the product is in the design category in what class. Knowledge of this classification is important to simplify the registration process. Even though in registration there are administrative and substantive inspection stages on the appropriateness of the industrial design being registered, it does not mean that registration of industrial designs is difficult. The applicant has many opportunities to complete these requirements if the examination team finds deficiencies and the registration can be withdrawn.
